The following terms of use govern the use of the open guest Wi‑Fi (hereinafter referred to as “Wi‑Fi”) on the business premises of Construction Technologies Holding GmbH, Reinhard-Wirtgen-Straße 2, 53578 Windhagen, Germany (hereinafter “CTH”), by its visitors.


§ 1 General

  • (1) The contractual parties are CTH and the respective user of the Wi‑Fi (hereinafter “User”).
  • (2) By entering a valid access code and clicking the “Log In” button on the login page, the User accepts these terms of use. The current version of the terms of use can be accessed at any time via a web browser at https://www.wirtgen-group.com/nutzungsbedingungen-wlan-cth .
  • (3) CTH is entitled to change these terms of use with effect for the future; the amended version will be presented to the User for confirmation upon the next login.
  • (4) Use of the Wi‑Fi is permitted exclusively in accordance with these terms of use.


§ 2 Description of Services

  • (1) CTH provides the User with free internet access within its business premises via wireless technology (Wireless Local Area Network), within the limits of its technical and operational capabilities. This is an internal Wi‑Fi network for CTH guests only and not a publicly accessible telecommunications service. Availability and transmission speed may vary depending on network load.
  • (2) Use of the Wi‑Fi requires entering a valid access code on the login page.
  • (3) Use of the Wi‑Fi requires a Wi‑Fi-enabled, operational device. Additionally, the device must have a suitable operating system, an appropriate internet browser, current software drivers, and a corresponding IP network protocol.


§ 3 User Obligations and Prohibited Use

  • (1) The User must protect their device against unauthorized access by third parties and ensure that no disruptions to the Wi‑Fi or other users’ devices originate from their device.
  • (2) The User must comply with applicable laws when using the Wi‑Fi. Any actions that violate applicable law are prohibited, including in particular:
    • a. using, posting, distributing, offering, or promoting pornographic, illegal, fraudulent, or otherwise unlawful content, services, or products;
    • b. publishing or making available content that insults or defames others;
    • c. using, providing, or distributing legally protected content or content subject to third-party rights (e.g., copyrights) without authorization, especially via file-sharing services.
  • (3) In addition, the following activities are prohibited:
    • a. excessive use of CTH systems that may disrupt Wi‑Fi operations (e.g., large data transfers such as video streaming);
    • b. hosting a web server or other servers via the Wi‑Fi;
    • c. manipulation of network components (e.g., changing preset DNS servers);
    • d. sending spam emails or using the Wi‑Fi for commercial purposes (e.g., advertising);
    • e. spreading false information (fake news);
    • f. distributing viruses, trojans, malware, or other harmful files;
    • g. distributing or communicating offensive, inappropriate, sexually explicit, obscene, or defamatory content, or content that promotes racism, fanaticism, hatred, violence, or illegal acts;
    • h. requesting passwords or personal data from others for commercial or unlawful purposes.
  • (4) In the event of alleged misuse or unlawful internet use, the User must fully cooperate in clarifying the matter and provide CTH with all necessary information promptly.


§ 4 Blocking and Termination

  • (1) The usage relationship ends automatically when leaving CTH premises, in the event of a technical disconnection, or upon expiration of any time limitation.
  • (2) CTH may modify, restrict, or permanently discontinue internet access at any time for valid reasons, particularly technical, operational, or legal reasons.
  • (3) CTH may temporarily or permanently block individual users if there are indications of violations of these terms or applicable law, or if CTH has another legitimate interest.


§5 Liability

  • (1) The User is responsible for all actions taken in connection with internet use via the Wi‑Fi, including transmitted data, services used, and legal transactions carried out.
  • (2) CTH is not liable for damage to data, hardware, or software of the User’s device, data loss, or other material damage caused by using the Wi‑Fi, unless such damage is caused intentionally or by gross negligence on the part of CTH.
  • (3) Otherwise, CTH is liable for damages or reimbursement of expenses—regardless of legal grounds—only as follows:
    • a. in full in cases of intent or gross negligence;
    • b. in full for injury to life, body, or health;
    • c. in all other cases, only for breach of essential contractual obligations, limited to foreseeable and typical damage.
  • (4) Compensation for foreseeable and typical damage is limited in total to €15,000.
  • (5) Liability under the German Product Liability Act remains unaffected.
  • (6) If third parties assert claims against CTH due to a violation by the User of these terms, legal regulations, or third-party rights, the User shall indemnify CTH against such claims, including legal defense costs.


§ 6 Final Provisions

  • (1) The law of the Federal Republic of Germany applies.
  • (2) If the User is a merchant, a legal entity under public law, or a special fund under public law, the registered office of CTH is the exclusive place of jurisdiction.
  • (3) Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
